Family Trust Navigates Environmental Issues in Sale of Parcel

Represented a private family trust that sought assistance in preparing a parcel of land for liquidation that was discovered to have significant subsurface contamination. Investigation of historic site records revealed prior operation of the site as a service station by a major oil company, which eventually agreed to complete the cleanup and indemnify the trust entity for the contamination. We further assisted this client by getting the prospective purchaser and its lender comfortable with the status and obligations of the indemnitor, and by facilitating interactions with the City of Stockton, San Joaquin County, the Regional Water Quality Control Board, and by determining eligibility for underground storage tank (UST) trust fund reimbursement of client cleanup expenses.
