Orange County Public Company Obtains Dismissal in Licensing Dispute with Samsung

Secured dismissal for an Orange County Public Company in an action brought by Samsung Display Co., Ltd. Samsung’s complaint arose from an agreement under which our client had licensed to Samsung a substantial portion of its patent portfolio, alleged breach of the agreement, tortious interference with prospective contractual relations, unfair competition, abuse of process, and prima facie tort. Samsung charged that several of our client’s affiliates had sued at least 17 Samsung customers for patent infringement under the agreement, and sought compensatory and punitive damages for purportedly having to indemnify each customer. We succeeded in getting all but the breach of contract claim dismissed before discovery began and, following a settlement conference and before any depositions were taken, we reached a favorable settlement for our client, and the court dismissed the case.
